1. Agreement to Terms

1.1 Acceptance of Terms

Welcome to GameHub Arena ("Platform," "Service," "we," "us," or "our"). 2. Eligibility and Account Registration

2.2 Parental Consent (COPPA Compliance)

If you are between 13 and 17 years of age (a "Minor"), you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf. Parents or legal guardians of Minors are responsible for monitoring their children's use of the Service and accept full responsibility for such use.

We comply with the Children's Online Privacy Protection Act (COPPA). If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will delete that information as quickly as possible. Parents who believe we may have collected information from a child under 13 should contact us at privacy@gamehubarena.fun.

2.3 Account Registration

To access certain features of the Service, including tournament participation, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information as prompted by the registration form
• Maintain and promptly update your registration information to keep it accurate and complete
• Choose a username that complies with our Community Guidelines (no offensive, impersonating, or misleading names)
• Create a strong, secure password and keep it confidential
• Immediately notify us of any unauthorized use of your account
• Accept full responsibility for all activities that occur under your account

2.4 Account Restrictions

You may not:

• Create more than one account per person ("smurf accounts" or "alt accounts" may result in suspension)
• Share your account credentials with any other person
• Sell, transfer, or allow others to access your account
• Use another person's account without permission
• Impersonate any person or entity
• Create accounts using automated means or false information

2.5 Geographic Restrictions

The Service may not be available in all countries or regions. Certain features, particularly tournaments with prizes, may be restricted based on your location due to legal requirements. You are responsible for ensuring your use of the Service complies with all applicable local laws.

2.6 Verification

We reserve the right to verify your identity, age, and eligibility at any time. You may be required to provide government-issued identification, proof of age, or other documentation. Failure to provide requested verification may result in account suspension or termination and forfeiture of prizes.

3. Account Security and Responsibilities

3.1 Account Security

You are solely responsible for maintaining the security and confidentiality of your account credentials. You agree to:

• Use a strong, unique password not used for other services
• Enable two-factor authentication (2FA) when available for enhanced security
• Never share your password with anyone, including GameHub Arena staff
• Log out from your account at the end of each session when using shared devices
• Immediately notify us at security@gamehubarena.fun if you suspect unauthorized access

3.2 Account Activity

You are fully responsible for all activities conducted through your account, whether or not authorized by you. This includes:

• Tournament registrations and participation
• Messages sent to other users
• Content uploaded or posted
• Purchases and financial transactions
• Violations of these Terms or Community Guidelines

GameHub Arena is not liable for any loss or damage arising from unauthorized use of your account resulting from your failure to maintain security.

3.3 Official Communications

Important Notice: GameHub Arena staff will NEVER ask for your password via email, chat, or any other means. Any such request is fraudulent. Official communications from us will come from @gamehubarena.fun email addresses. Be cautious of phishing attempts.

4. Platform Access and License

4.1 Limited License

Subject to your compliance with these Terms, GameHub Arena grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Access and use the Service for personal, non-commercial purposes
• Download and use any mobile applications we provide on devices you own or control
• Participate in tournaments and competitions
• Interact with the community within the bounds of our guidelines

This license does not include any right to: (a) resell or commercial use of the Service; (b) distribution, public performance, or public display; (c) modifying or making derivative works; (d) use of data mining, robots, or similar data gathering tools; or (e) downloading content except as expressly permitted.

4.2 Service Availability

We strive to provide reliable, uninterrupted service, but we do not guarantee that:

• The Service will be available at all times or without interruption
• The Service will be error-free or secure from unauthorized access
• Servers will be free from viruses or harmful components
• Results from using the Service will be accurate or reliable

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, for maintenance, updates, or any other reason.

4.3 System Requirements

You are responsible for obtaining and maintaining all equipment, software, and internet connectivity necessary to access the Service. We are not responsible for your inability to access the Service due to your equipment or connectivity issues.

4.4 Updates and Modifications

We may update, modify, or enhance the Service periodically to improve functionality, add features, fix bugs, or comply with legal requirements. Some updates may be automatic, while others may require your action. You agree to accept such updates as a condition of continued use.

5. Tournament Rules and Competition

5.1 Tournament Participation

By participating in tournaments on GameHub Arena, you agree to:

• Comply with all general Tournament Rules and game-specific regulations
• Check in before scheduled match times as required
• Play all matches fairly without cheating, exploits, or unauthorized assistance
• Treat opponents, teammates, and officials with respect
• Accept tournament administrator decisions regarding disputes
• Report match results accurately and promptly

5.2 Match Scheduling and Conduct

You must:

• Be available at scheduled match times or coordinate rescheduling through proper channels
• Respond to match notifications within specified timeframes
• Join voice chat or communication channels when required by tournament format
• Use approved game settings, servers, and configurations
• Provide match evidence (screenshots, replays) when requested

Failure to appear for scheduled matches may result in forfeit, disqualification, or tournament bans.

5.3 Seeding and Brackets

Tournament seeding is determined by our ranking algorithms based on your competitive history, skill rating, and performance. We reserve the right to adjust seeding to ensure fair competition. Bracket manipulation, collusion with opponents, or intentional seeding manipulation is prohibited.

5.4 Disputes and Appeals

Match disputes must be filed through official channels within 30 minutes of match completion. Disputes should include:

• Specific issue being disputed
• Evidence supporting your claim (screenshots, replays, timestamps)
• Match ID and tournament information

Tournament administrator decisions are final unless exceptional circumstances warrant review. Appeal processes are outlined in specific tournament rules.

5.5 Disqualification

We reserve the right to disqualify participants for:

• Cheating or use of unauthorized software/hardware
• Toxic behavior, harassment, or unsportsmanlike conduct
• Match fixing or collusion
• Violation of tournament rules or these Terms
• False information or fraudulent registration

Disqualification may result in prize forfeiture, ranking penalties, and account suspension.

6. User Conduct and Acceptable Use

6.1 Prohibited Activities

You agree NOT to engage in any of the following prohibited activities:

A. Illegal Activities

• Violating any applicable local, state, national, or international law
• Engaging in fraud, theft, or money laundering
• Distributing illegal substances or weapons
• Promoting terrorism or violent extremism

B. Harmful Conduct

• Harassment, bullying, stalking, or threatening other users
• Hate speech, racism, sexism, homophobia, or discrimination
• Doxxing (sharing personal information without consent)
• Impersonating others or misrepresenting affiliations
• Sexual harassment or unwanted sexual advances

C. Cheating and Exploitation

• Using cheats, hacks, aimbots, wallhacks, or unauthorized third-party software
• Exploiting bugs, glitches, or game mechanics for unfair advantage
• Match fixing, win trading, or collusion with opponents
• Account boosting or playing on others' accounts in competitive matches
• Smurfing (experienced players using low-ranked accounts to dominate)

D. Platform Abuse

• Spamming, flooding, or mass messaging
• Advertising commercial products or services without authorization
• Scraping, data mining, or using automated tools to extract data
• Attempting to bypass security measures or access restrictions
• Interfering with or disrupting the Service or servers
• Reverse engineering, decompiling, or disassembling any part of the Service

E. Content Violations

• Posting or sharing illegal, obscene, or sexually explicit content
• Distributing malware, viruses, or malicious code
• Infringing on intellectual property rights (copyright, trademark, patents)
• Posting personal information of others without consent
• Promoting scams, phishing, or fraudulent schemes

6.2 Enforcement

Violations of these conduct rules may result in:

• Content removal
• Temporary or permanent chat restrictions
• Tournament bans
• Account suspension or termination
• IP address blocking
• Legal action and law enforcement reporting

6.3 Reporting Violations

If you encounter violations of these rules, please report them through:

• In-platform reporting tools

• Support ticket system

Include detailed information, evidence, and timestamps to help our moderation team investigate.

7. User-Generated Content

7.1 Content You Provide

"User Content" refers to any content you submit, upload, post, or transmit through the Service, including but not limited to:

• Profile information (username, bio, avatar)
• Messages, comments, and forum posts
• Screenshots, videos, and gameplay recordings
• Tournament submissions and match evidence
• Reviews, ratings, and feedback

7.2 License Grant to GameHub Arena

By submitting User Content, you grant GameHub Arena a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to:

• Use, reproduce, modify, adapt, and publish your User Content
• Display, perform, and distribute User Content on the Service
• Create derivative works based on User Content
• Use User Content for promotional, marketing, and advertising purposes
• Sublicense these rights to third parties in connection with the Service

This license continues even if you stop using the Service or delete your account, except that we will cease using User Content for new promotional materials after account deletion.

7.3 Your Representations and Warranties

By submitting User Content, you represent and warrant that:

• You own or have necessary rights to the content
• The content does not infringe on any third-party rights (copyright, trademark, privacy, publicity)
• The content complies with all applicable laws and these Terms
• The content does not contain viruses or malicious code
• You have obtained all necessary consents, releases, and permissions

7.4 Content Moderation

We reserve the right, but have no obligation, to:

• Monitor, review, or screen User Content
• Remove, modify, or refuse to display any User Content
• Take action against users who violate content policies

We do not endorse any User Content and are not responsible for accuracy, integrity, or quality of User Content posted by users.

7.5 Copyright Infringement

We respect intellectual property rights. If you believe content on our platform infringes your copyright, please follow the procedures outlined in our DMCA Policy.

7.6 Feedback and Suggestions

If you provide feedback, suggestions, or ideas about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback without compensation or attribution.

8. Intellectual Property Rights

• Premium Services: Subscription plans, exclusive tournaments, advanced features, premium support

9.2 Subscription Plans

Premium subscriptions may be purchased on a monthly or annual basis. By subscribing, you agree to:

• Pay the subscription fee at the start of each billing period
• Automatic renewal unless cancelled before the renewal date
• Price changes with 30 days' notice for existing subscribers

9.3 Payment Methods

We accept various payment methods including credit cards, PayPal, and cryptocurrency. By providing payment information, you represent that:

• You are authorized to use the payment method
• The information is accurate and current
• You will pay all charges incurred

9.4 Cancellation and Refunds

Subscriptions: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds for unused time.

One-Time Purchases: Generally non-refundable except as required by law or for technical issues preventing use. Refund requests must be submitted within 14 days.

Tournament Entry Fees: Non-refundable once tournament begins unless tournament is cancelled by us.

9.5 Taxes

All fees are exclusive of applicable taxes unless stated otherwise. You are responsible for paying all taxes associated with your purchases.

9.6 Price Changes

We reserve the right to change prices for paid services with 30 days' advance notice. Continued use after price changes constitutes acceptance of new prices.

10. Prizes and Rewards

10.1 Prize Eligibility

To be eligible for tournament prizes, you must:

• Meet age requirements (18+ for cash prizes in most jurisdictions)
• Comply with all tournament rules and these Terms
• Complete identity verification when requested
• Reside in a jurisdiction where prize awards are legal
• Not be an employee or immediate family member of GameHub Arena

10.2 Prize Types

Prizes may include:

• Cash prizes (subject to tax reporting and withholding)
• Virtual currency or platform credits

• Changes to game mechanics affecting tournaments

13. Anti-Cheating and Fair Play

13.1 Commitment to Fair Competition

GameHub Arena is committed to maintaining fair, competitive integrity in all tournaments and matches. Cheating undermines the experience for all participants and will not be tolerated.

13.2 Prohibited Cheating Methods

The following are strictly prohibited:

• Software Cheats: Aimbots, wallhacks, ESP, radar hacks, trigger bots, recoil scripts
• Hardware Cheats: Modded controllers, macro keyboards, hardware-based aimbots
• Exploits: Bug exploitation, glitch abuse, map breaking
• Collusion: Match fixing, win trading, intentional losing, prize splitting agreements
• Ghosting: Receiving information from spectators during live matches
• Account Manipulation: Smurfing, account sharing, boosting services
• Stream Sniping: Using opponent streams to gain competitive advantage

13.3 Anti-Cheat Technology

We employ various anti-cheat measures including:

• Real-time monitoring systems
• Machine learning pattern detection
• Manual review by trained staff
• Integration with game-specific anti-cheat systems
• Community reporting mechanisms

13.4 Investigations

When cheating is suspected, we may:

• Temporarily suspend accounts pending investigation
• Review match replays and statistical anomalies
• Request additional verification or evidence
• Coordinate with game publishers' anti-cheat teams

13.5 Penalties for Cheating

Confirmed cheating results in severe penalties:

• First Offense: 30-90 day ban, prize forfeiture, ranking reset
• Second Offense: 6-12 month ban, permanent tournament exclusion
• Third Offense or Egregious Cheating: Permanent account termination, IP ban, legal action

Penalties may escalate immediately for commercial-scale cheating or selling cheating services.

13.6 Appeals

If you believe you were wrongly accused of cheating, you may appeal by:

• Submitting detailed appeal to appeals@gamehubarena.fun within 30 days
• Providing evidence supporting your innocence
• Cooperating with investigation (may include screen sharing, software scans)

Appeal decisions are final and made at our sole discretion.

14. Account Suspension and Termination

14.1 Termination by You

You may terminate your account at any time by:

• Accessing Account Settings and selecting "Delete Account"
• Contacting support@gamehubarena.fun with deletion request

Upon termination:

• Your access to the Service ceases immediately
• Active subscriptions are cancelled (no refunds for unused time)
• Most personal data is deleted per our Privacy Policy
• Some data may be retained for legal compliance (transaction records, dispute history)
• Usernames may not be immediately available for reuse

14.2 Termination by GameHub Arena

We reserve the right to suspend or terminate your account, at our sole discretion, without notice or liability, for any reason including:

• Violation of these Terms or Community Guidelines
• Fraudulent activity or payment disputes
• Cheating or competitive integrity violations
• Repeated complaints from other users
• Suspected security breaches
• Prolonged inactivity (typically 2+ years)
• Legal requirements or court orders

14.3 Effects of Termination

Upon termination by us:

• Your license to use the Service terminates immediately
• You forfeit any unclaimed prizes or credits
• Ongoing tournament registrations are cancelled
• Premium subscription benefits cease (no pro-rated refunds)
• You may be prohibited from creating new accounts

14.4 Survival

The following sections survive termination: User Content licenses, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions.

15. Disclaimers and Warranties

15.1 "AS IS" and "AS AVAILABLE" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, GAMEHUB ARENA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties regarding security, accuracy, reliability, timeliness, and performance
• Warranties that the Service will be uninterrupted, secure, or error-free

SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY HAVE ADDITIONAL RIGHTS THAT VARY BY JURISDICTION.

16. Limitation of Liability

16.1 Limitation on Types of Damages

TO THE FULLEST EXTENT PERMITTED BY LAW, GAMEHUB ARENA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Damages resulting from unauthorized access to your account or data
• Damages resulting from third-party conduct or content
• Damages resulting from errors, mistakes, or inaccuracies of content
• Personal injury or property damage resulting from Service use
• Damages resulting from interruptions or cessation of the Service

16.2 Cap on Liability

IN NO EVENT SHALL GAMEHUB ARENA'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF:

• One hundred dollars ($100 USD), OR
• The amount you paid to GameHub Arena in the twelve (12) months preceding the claim

16.3 Basis of the Bargain

These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if GameHub Arena has been advised of the possibility of such damages. These limitations reflect the allocation of risk between the parties. The Service would not be provided without these limitations.

16.4 Exceptions

18. Dispute Resolution and Arbitration

18.1 Informal Resolution

Before filing a formal dispute, you agree to first contact us at legal@gamehubarena.fun to attempt informal resolution. Describe the dispute and your desired resolution. We will attempt to resolve the dispute informally within 60 days.

18.2 Binding Arbitration

IF INFORMAL RESOLUTION FAILS, YOU AND GAMEHUB ARENA AGREE THAT ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL BE RESOLVED THROUGH BINDING ARBITRATION, RATHER THAN IN COURT, EXCEPT AS SET FORTH BELOW.

18.3 Arbitration Rules

Arbitration will be conducted by a neutral arbitrator in accordance with:

• American Arbitration Association (AAA) Consumer Arbitration Rules
• Federal Arbitration Act (FAA) for U.S. residents
• Applicable international arbitration rules for non-U.S. residents

18.4 Exceptions to Arbitration

Either party may bring claims in small claims court if they qualify. Additionally, either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service.

18.5 CLASS ACTION WAIVER

YOU AND GAMEHUB ARENA AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU AND WE WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS. You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or class member in a class, consolidated, or representative action.

18.6 Arbitration Costs

Each party will bear their own attorneys' fees unless the arbitrator awards fees as part of the decision. GameHub Arena will pay all AAA filing, administration, and arbitrator fees for non-frivolous claims under $10,000.

18.7 Opt-Out Right

You may opt out of arbitration within 30 days of first accepting these Terms by sending written notice to legal@gamehubarena.fun with subject "Arbitration Opt-Out" including your name, username, and statement that you opt out of the arbitration provision.

18.8 Governing Law
